The Punjab and Haryana High Court has set a two-month deadline for the State of Punjab and its authorities to see whether brakes need to be applied to the practice of modifying cars into limousines for taxi purposes.
The deadline by the Bench of Acting Chief Justice MM Kumar and Justice Alok Singh came on a petition filed in public interest by Jugni Cultural and Youth Welfare Club against the State of Punjab and other respondents through counsel DS Patwalia.
The petitioner had, in fact, sought the issuance of directions to the respondents “to restrain the taxi and tour operators, who use private cars as limousine taxi by modifying and altering its body structure unauthorisedly”.
The petitioner had added that the conversion was carried “without sanction from the requisite authority and in violation of the provisions of the Motor Vehicle Act”. In the process, they were “causing not only danger to the life of persons, who are travelling in the vehicles, but also to the public at large”.
Directions were also sought to the respondents “to take necessary stringent and preventive steps like impounding of vehicles, cancellation of registration certificates and imposition of fine as per the Motor Vehicle Act, 1988.
Further directions to the respondents “to take similar action against all other unauthorised modifications and alterations done by the commercial vehicles” were also sought.
Taking up the matter, the Bench asserted: “In this regard, the petitioner has already made a complaint dated February 15, 2012. However, no action is stated to have been taken.”
Disposing of the petition, the Bench added: “Without going into the merits of the case, we deem it just and appropriate to direct respondents to take cognisance of the complaint made by the petitioner, and decide the same expeditiously preferably within a period of two months from the date a certified copy of this order is presented to them. It shall be appreciated if a speaking order is passed”.
